Property Reuse for Public Benefit

     TechLaw views property reuse and redevelopment as important elements in our environmental consulting practice. We synthesize our technical capabilities with social responsibility, to create a variety of outcomes for public benefit. TechLaw offers a range of related services, which we have provided in support of national programs and agencies, as well as state and local initiatives. Our property reuse services include the following:

Public Participation – TechLaw has experience supporting city, county, and state agencies with public participation activities associated with a Brownfields program. We support clients in a variety of associated activities, which can involve providing information about a particular program or progress at a specific site. TechLaw has supported clients during hundreds of public meetings, mostly in conjunction with other technical work. Our public participation experience includes tasks such as locating and reserving a facility, reserving equipment, securing court reporters and translators, preparing related materials, registering and compiling lists of attendees, and providing other necessary support during the meetings.

Environmental Site Histories (ESHs) and Title Searches – For over 20 years, TechLaw has performed ESH research that integrates information obtained from various research tasks to develop a comprehensive understanding of the activities of parties associated with a site and identify the waste streams and contaminants produced by these activities. ESHs identify potential site contaminants and locations where contamination might be found—they provide a basis for identifying areas of no further action, and selecting and prioritizing appropriate remedial activities, including risk-based approaches. We have developed ESHs for over 1,500 sites (mostly industrial facilities). An ESH preserves collected records for later use, and provides documentation for possible distribution to regulatory agencies and the public for outreach activities.

Land Planning Support Services – Companies proposing to purchase, sell, or use undeveloped land may be subject to regulations designed to protect wetlands, forests, cultural resources, and threatened or endangered species. Land buyers and developers must ensure plans do not conflict with particular land use restrictions. TechLaw offers clients the technical and regulatory support necessary to ensure land purchases and proposed development of both undeveloped and developed property are conducted in full compliance with federal, state, and local requirements.

Projects
 
Advanced RCRA Corrective Action Symposium on RCRA Brownfields and Public Participation, EPA
Region 4, Atlanta, Georgia
At the request of EPA, TechLaw developed and presented a 2½-day workshop that highlighted tools for redevelopment and reuse to state regulators; shared information about the regulatory issues surrounding advanced corrective action; and allowed attendees to share case examples and discuss them with their experienced peers. Specific topics discussed included: Site Conceptual Model Design; Remedy Selection Process and Design; Institutional Controls; Cleanup Standards; Financial Assurance and Project Cost Estimation; and Brownfields Redevelopment and Reuse Tools (statutory, financial, liability/risk sharing, technical, and public participation). The workshop will be available on an interactive Web site. The public participation portion of this training has been submitted to EPA Region 4 for their review and a work plan has been prepared to carry out this training. This course is also expected to be available online.
Community Dialogue
TechLaw assisted a 100-year-old active industrial facility in the heart of a mixed use urban area to create an environmental and redevelopment dialogue. TechLaw enlisted its public participation experts to identify and interview the neighbors to determine the best means of communicating future plans and any concerns with the demolition of several of the facility’s back buildings. To develop a public participation plan, TechLaw visited the facility and toured the neighborhood. Overall, the neighbors were supportive of the planned demolition and improvements. A Neighborhood Community Watch Coordinator was identified and agreed to be a point-of-contact for neighbors with questions or concerns and to assist in the development of future public meetings for the facility.

Habitat for Humanity East Bay

TechLaw is currently providing remediation and public outreach support for a Habitat for Humanity Site in Oakland, CA. TechLaw’s scope of work at the Edes B site includes scoping work with the California Department of Toxic Substances Control (DTSC); site assessment plan preparation; SAP/QAPP preparation; response plan preparation and implementation; and a complete response plan implantation report. TechLaw will use its community outreach and facilitation skills to assist in communicating issues and developments with stakeholders, and to maximize the impact that this affordable housing project will have on the community.
